Terms and Conditions 

Thank you for taking the time to read these terms and conditions. We are thrilled that you want to hold an activity to raise funds to help families out of poverty through Opportunity International Australia (Opportunity). Your support makes such a difference! 

These terms and conditions apply to groups and individuals (your or you) that are planning to organise events or activities to raise funds on behalf of Opportunity. By accepting these terms and conditions, you agree to comply with and be bound by them. You must also ensure that anyone assisting you with your fundraising activities also complies with the terms and conditions.

Opportunity may change these terms and conditions from time to time. It is your responsibility to carefully read through this document before accepting these terms and conditions.

All fundraising events or activities should also be conducted in accordance with:

AUTHORISATION

1. Upon registration, we will issue you with a Letter of Authority to fundraise for your event or activity. We reserve the right to withdraw your approval to fundraise or ask for further information should we develop any reasonable concerns.

2. You may fundraise during the approved dates only in accordance with your Letter of Authority, and only for the approved event or activity. If you wish to extend or change any aspect of your fundraising event or activity, please contact us as soon as possible. Our contact details are at the bottom of this page.

3. Due to the nature of our work and the high ethical standards under which we operate, there may be some events and activities we prohibit. Specifically, you, as a fundraiser for Opportunity, must not engage in events and activities that:

  • involve telemarketing, door knocking, collection tins or buckets, soliciting donations from occupants of vehicles or in public places such as shopping centres;
  • involve the sale or promotion of tobacco or vaping products or illegal drugs, or that are in any way connected with illegal activity; or
  • are in any way connected with terrorism, the use of landmines or money laundering.

If alcohol will be served at your event, you must ensure the responsible service of alcohol in accordance with any licensing requirements which apply in your State or Territory (see clause 6 below). Opportunity may, at its discretion (acting reasonably) prohibit other events or activities in order to maintain its high ethical standards.

4. We may at any time by notice in writing withdraw your approval to fundraise if it appears there is a likelihood or evidence of the fundraiser failing to adhere to any of these terms and conditions. In this situation, all fundraising must cease, and you must, within seven days of receiving the notification, return your Letter of Authority, all money raised and any materials displaying the Opportunity name or logo.

5. From time to time, we may require you to comply with other reasonable requests from Opportunity. You agree to comply with such requests if they are made, and within a reasonable time.

ORGANISING AND RUNNING YOUR EVENT OR ACTIVITY

6. It is your responsibility to comply with all relevant legislation and/or regulations in the State or Territory in which your fundraising event or activity is taking place (Relevant Laws). You are also responsible for obtaining and complying with permits, approvals, consents, gaming licenses or other requirements associated with the fundraising event or activity (Relevant Requirements).

This includes rules and requirements relating to raffles, lotteries, auctions, sweepstakes, bingo and other games of chance, some of which require a license. States and Territories vary in this regard. We recommend that you seek guidance from the relevant gaming authority in the relevant States and Territories before engaging in any activity of this nature.

7. All Victorian fundraisers aiming to raise $10,000 or more must have a Fundraising Licence (in addition to Opportunity’s Authority to Fundraise). To obtain this licence, you must complete the Victorian Fundraising Licence Application form and submit it to Consumer Affairs Victoria. You must obtain a Fundraising Licence in order for your Authority to Fundraise to be valid.

8. You must make it clear in any dealings with the public, donors, sponsors and supporters that you are raising funds for Opportunity, but you are not our agent, and you are not authorised to act on behalf of Opportunity. Acceptance of a donation by you does not imply endorsement by Opportunity of any person or organisation.

9. By agreeing to these terms and conditions, you verify that you are physically and mentally able to organise and run your fundraising event or activity. You also acknowledge that you are aware of any risks involved and voluntarily agree to undertake all fundraising events and activities at your own risk.

10. Opportunity (including its Directors, staff, volunteers and Ambassadors) is not liable for any injury, damage or loss arising from or connected with (directly or indirectly) any of your fundraising events or activities, including your failure to comply with any Relevant Laws or Relevant Requirements in connection with any of your fundraising events or activities.

11. If an Opportunity representative is present at an event or activity, you remain solely responsible for all aspects of the activity or event unless otherwise prearranged and agreed between you and the Opportunity representative.

12. You agree to notify us before you approach any corporate sponsors as Opportunity has existing relationships with a number of corporate partners that may need to be taken into consideration.

13. Opportunity’s Public Liability Insurance Policy covers approved events with under 500 attendees. For events with 500 or more attendees, you are responsible for arranging the necessary public liability insurance. Public liability insurance cover protects you, as the event organiser, from any claim against you for the personal injury and/or property damage sustained by a third party because of your negligence or alleged negligence. For events with 500 or more attendees we recommend using PSC Insurance Brokers (Aust) Pty Ltd and have negotiated a policy that allows you to obtain cover for your event at a very reasonable premium. Please contact us if you would like further information. Alternatively, we suggest that you hold your event at a venue which is already covered by public liability insurance.

14. You understand that due to limited resourcing, Opportunity is unable to take a coordination role in your activities, nor are we able to assist in soliciting prizes, organising publicity or providing goods or services to help you in the running of the activity.

PRIVACY AND PERSONAL INFORMATION

15. We will not provide you with information from our donor database or any other personal information of current or prospective donors. This is because we are bound by privacy laws and our own Privacy Policy.

16. As a fundraiser, you must protect the privacy and personal information of the people you come in contact with during the course of your fundraising. You are required to read our Privacy Policy and help ensure that Opportunity complies with laws relating to privacy. You, and any other person assisting you with your fundraising activity or event, must ensure that you:

  • only collect personal information from a supporter or donor that is necessary for the functions or activities of the fundraising (eg collecting name and contact details for issuing a receipt or posting an event ticket), and will always make is clear why this information is being collected;
  • do not copy, use or disclose personal information other than for the primary purpose of fundraising for Opportunity (eg collecting name and contact details for issuing a receipt or posting an event ticket).
  • only collect credit card details from supporters on an Opportunity donation form, which you can request from us. These forms must be kept secure until they are delivered to Opportunity, which must be done in a secure manner.

17. We will treat any personal information you pass on to us in accordance with the Australian Privacy Principles contained in the Privacy Act 1988 (Cth) and our own Privacy Policy.

PUBLICITY

18. Any use of our logo, text, images or any other branding must be consistent with the standard set on Opportunity’s website (www.opportunity.org.au). Please contact us at our contact details below if you need assistance with any collateral, logo or images.

19. While we will not undertake media relations on your behalf, we are happy to provide advice on producing media materials. All printed material, including press releases, must be approved by Opportunity International Australia. Please notify us if you intend to approach any media.

20. You must ensure that all publicity in connection with your event or activity and Opportunity International Australia is not deceptive or misleading and is clear and accurate in its explanation of:

  • what you will do with the money raised (ie pass directly onto Opportunity International Australia);
  • what Opportunity International Australia will do with the money raised (ie use for development work);
  • the prizes or benefits on offer in connection with your fundraising event or activity;
  • the tax deductibility or otherwise of donations made in connection with your fundraising activity;
  • the portion of the money raised that will be donated to Opportunity International Australia (eg whether 100% of money raised will be given to Opportunity International Australia and if you will cover your own costs or if expenses will be deducted from the money raised).

INVOLVING CHILDREN

21. If you are under 16 years of age, you must have the express permission of a parent or guardian before undertaking any fundraising activities or hosting a fundraising event.

22. You must inform us if you anticipate that your fundraising activity will involve contact, or working with or alongside children under the age of 18 at any time. If this is the case, we will send you our Child Protection Policy, our Prevention of Sexual Exploitation, Abuse and Harassment Policy, and our Safeguarding Code of Conduct which you must read, sign and return to us. You must also comply with any working with children licensing requirements which apply in your State or Territory (see clause 6 above). Any children present at your fundraising activities must be supervised by their parent or guardian at all times.

23. Fundraising on school grounds is not permitted unless you are a student, teacher or staff member at the school where you intend to fundraise and you have express written consent from the school Principal or authorised representative.

RECEIVING MONEY

24. The rules and regulations about providing tax receipts and what is and isn’t a tax-deductible gift can be quite technical. Tax deductibility can be claimed for gifts of $2 or more. To receive tax deductibility, the donor must not have received anything in return – therefore ticket sales, auction purchases and entry fees are not eligible.

25. All donations should be directed to your approved online fundraising page in the first instance. This page will automatically issue tax-deductible receipts. Only Opportunity can issue tax deductible receipts. You are not permitted to issue receipts on our behalf. If a cash donation is received and supporters wish to receive a tax-deductible receipt, they must complete a donation form which you can request from us. Please note a tax-deductible receipt for cash donations can only be issued upon receipt and banking of the funds.

MANAGEMENT OF FINANCES

26. All costs and debts associated with your fundraising activities or event are your responsibility and we will not be liable for any financial loss suffered by you or those you involve.

27. Opportunity International Australia does not generally reimburse expenses incurred by fundraisers. However we may consider it in exceptional circumstances. Please contact us if you would like to discuss your fundraising activity.

28. Opportunity complies with charitable fundraising guidelines in all States and Territories which state that expenses incurred from your fundraising event or activity can be deducted from money raised but only if total expenses are less than 50% of the funds raised and they are accurately and properly documented. To help ensure proper management of money raised during your fundraising event or activity, you agree to:

  • keep accurate financial records (such as retention of receipts and invoices);
  • provide us with an accurate record of money raised and expenses associated with the event or activity within four weeks of the conclusion of the event or activity; and
  • never deposit funds raised for Opportunity into a personal bank account. You must deposit all funds raised directly into Opportunity’s account (we will provide details) as soon as practical and no later than 3 (three) business days after receipt of the funds. Please contact us if you have any questions about banking of funds raised.

29. Any cash received at an event must be counted by two people and recorded – both people must sign a document confirming the total counted. Opportunity will provide a template for recording cash gifts upon request (refer contact details below).
